I, Joseph McKay of the County of Warren and State of Virginia being in feeble health but sound in mind and memory make this my last will and testament hereby revoking all wills and testaments heretofore made by me-- 1st After all my just debts are paid I will and bequeath to my niece Sarah J. Melton and my nephew Joseph McKay all my landed estate on Crooked Run to be divided between them in the following manner: Beginning at a point on the Front Royal Turnpike 3 panels of fence North of two cedars standing near together a short distance from a mile post, thence West to where a fence crosses a hollow down said hollow to where another hollow makes in, thence North up the middle of said hollow to the top of a hill in line with a new fence now being made on the side of the hill above the old stone house & the limestone spring to a point near the road leading to the Sulphur Spring House opposite a wild cherry tree, down the East side of said road to where it crosses the old fence row on the side of the hill, down said fence row till it reaches a fence near a locust tree, thence North to a walnut on the West bank of the run, down the bank of the run to a point where the hill comes near a creek, thence SW to a point near a spring in a deep hollow in the woods on the opposite bank from the spring, thence due West to Stony hollow, then with the meandering of the hill on the East bank of the stream to John Gardner's line: All the land lying North of this line I will to Sarah J. Melton and all on the South of said line, I will to Joseph McKay. 2nd I further will and bequeath to my nephew John W. McKay my farm near Milldale known as the Allen farm. 3rd To my nephew Thomas B. Kenner, I will my Island Ford Mill property with all the appurtenances thereto belonging and desire him to pay to Hannah Gore 600 dollars, to Benton Kenner's wife $600, to Alexander Kenner's wife $300 and to Rebecca White $300, making in the aggregate $1800. The interest to commence on the above ten years after my death and to be paid in annual installments of one, two and three years from that time. The property willed to the said Thomas B. Kenner is made liable for the payment of the above legacies. 4th I will to Eliza Haycock by request of my late wife Dolly Ann $1,000, to F.A. McKay $400, to Mrs. H.H. Painter $600, amounting in the aggregate to $2,000 all of which I will Joseph McKay shall pay to the parties named in one, two and three years after my death, the first to bear interest from my death, and the land willed above to the said Joseph (John W.) McKay is made liable for the payment of same. 5th To my niece Rebecca Danner, I will the sum of $1400, To John R. Painter $800, To Thomas N. Garrison $800, To Elizabeth Hicks $200, amounting in the aggregate to $3,200, all of which I desire John W. McKay shall pay to the parties named in annual installments of one, two and three years to commence two years after my death and bear interest from that time, and the land willed above to the said John W. McKay is made liable for the payment of the same. 6th I will to Julia and Anne Melton $500 each ($1,000), To Abraham Shulls three daughters by his second wife $600 each ($1,800), to his son Joseph by his third wife $400, and to Sarah J. Buck $200, the above named sums amounting to $3,400 I will and desire S.J. Melton shall pay to the above named parties in one, two and three years, to commence two years after my death and not to bear interest till the expiration of that time. The lands willed to the said S.J. Melton are hereby made liable for the payment of same. 7th By request of my beloved wife Dolly Ann, I will the household and Kitchen furniture in the following manner--To Joseph McKay the chairs, tables and curtains in the parlor, one bed and bedding in addition to the one he has already gotten, one looking glass and the balance of my earthenware, tea and Albatta spoons and one set of knives and forks; To John W. McKay the parlor carpet, one bed and bedding, to his daughter Mollie the China ware, the beds and bedding in the chamber; I will to Hannah Gore the tin safe, the split bottom chairs and $100 in money to be paid by Joseph McKay in the same way as to time and interest as he is ordered to pay the other legacies above. To my wife's niece Dolly, daughter of Abram Shull, the large silver spoons, the balance of my household furniture to be equally divided between John W. $ Joseph McKay. These requests of my wife Dolly Ann are my requests to all intents and purposes. 8th I also will that Joseph McKay shall pay to Eliza Haycock the additional sum of $200, payable in one, two and three years, to commence two years from my decease, but to draw interest from my death. 9th I further will that John W. and Joseph McKay shall pay to Mary Ann Robinson, if she survives her present husband, an annuity of $100, to commence 12 months after her husband's death and the property willed them to be liable for the payments. 10th I will and desire that the graveyard near Nineveh known as the Quaker Graveyard shall be enlarged by extending it 20 feet North and the wall around the old yard torn down and a new and substantial mortar wall ordered around the whole, well capt with large flat stones--use gravel and cement and the whole to be well painted. And I hereby authorize my Executors to have this work done and appropriate a sufficient sum out of my money belonging to my estate for that purpose. The above work to be done within two years after my death. 11th In case my bonds and other personality not disposed of by this will are not sufficient to pay all my debts, I desire the deficiency to be paid by John W. and Joseph McKay and S.J. Melton in proportion to the respective amounts they receive by this will, each one selecting one person to fix the value thereof, and in case there is surplus I wish the remainder to be equally divided between the children of my sister Rachel Kenner. 12th I wish and authorize my Executors to procure Tombstones like those at the grave of Joshua A. McKay and put them at the graves of my wife and my own. 13th It is my wish and desire that E.A. McKay and Eliza Haycock should attend to putting up the Tombstones at our graves and the Executors are authorized to pay them $10 each for their attention to same. If the parties named above who are to pay the legacies to the different legatees are unable to meet them as they mature, it is my wish that a reasonable time shall be allowed to meet them. And lastly I appoint John W. McKay and W.A. Melton my Executors to this my last will and testament and desire they shall receive $200 each for their services.
