McKay of the County of Warren and State of Virginia, being weak in body but sound of mind and good memory do make this my last will and testament. First it is my will that all my just debts and funeral expenses shall be paid. Secondly I will and desire that my beloved wife Esther Ann McKay, shall have all my real estate south of the road leading from the Turnpike road to the point of Wheelwright's Woods which is of the home farm, with the privilege of fire wood and timber for necessary purpose on the farm from the other part of the farm or from the Pine hills. I also give to my beloved wife her choice of two horses & 3 cows and all my household kitchen furniture. Thirdly I will the balance of my landed estate to be rented out by my executors and the rents to be applied to the payments of my debts. Fourthly I will and devise all my personal property to be sold except what I have here in before given to my beloved wife and the proceeds to the payment of my debts should my creditors not be willing to indulge my estate until the balance of my debts due be paid from rents as provided in the foregoing. Fifth I hereby authorize and empower my executors without the certification of a search for a title to execute and convey my interest in that portion of the Richardson farm purchased by Joseph McKay, Thomas B. Massie, J.H. McKay and myself of Wm. W. Eastham trustee of J.W. McKay's estate whenever sold. The residue of my estate, both real and personal including the portion left to my beloved wife during her lifetime is to be equally divided between my dear children, Nancy Antrim McKay and Joshua A. McKay and Francis H. McKay, as they severally become of age. And if either should die under age, his or her portion should go to the others. Sixth I will and wish Washington Wells, a free colored man, to have the house and 30 acres of land attached in the Pine hills occupied by George Way, during his natural life, he paying $12 per annual to my estate for the use of the same, the said house and land in no way whatsoever is to be liable for said Wells' debts (as he will be only a tenant) now or hereafter contracted. I hereby request the said Washington Wells to render unto my beloved wife any assistance he can in her farming operations, she paying him whatever such services may be worth. I wish and desire my dear cousin Eliza Haycock to continue to make her home with my beloved wife as long as she remain single and particularly request my wife and children to extend to her all the kindness and assistance she may need. Seventh I hereby appoint Joseph McKay and Jesse H. McKay my executors of this my last will and testament and in testament thereof I hereby subscribe my name and affix my seal this 10th day of July 1861. J.A.
