The Last Will & Testament of Floyd McKay

xxxxxIn the name of God Amen: I Floyd McKay, of the County of Jefferson and State of Indiana being of sound and disposity mind and memory do hereby make and publish this will and testament, hereby revoking any and all other wills by me at any time heretofore made.

xxxxxItem first: I will and bequeath all of my Real Estate and personal property to my wife Lucinda McKay during her life time, and at her death the property real and personal is to be equally divided among my legal heirs, except my daughter Louisa, who shall have two hundred dollars over and above the others.

xxxxxItem second: I will that in case of the death of my wife Lucinda McKay before Otto son of Mary Lauderbaugh attains his majority, the one half part of Mary Lauderbaugh's interest in my estate be held in trust by Albert McKay for the said Otto until he shall have attained his majority.

xxxxxWe Alexander Oliver, James K. Reed attesting witnesses to the above and foregoing will of Floyd McKay, signed the same as attesting witnesses thereto in the presence of each other, he the testator at the time acknowledging said will to be his last will and testament and acknowledging to us that his signature there to was genuine.

Probation of Floyd McKay's last will and testament

xxxxxOn this day appeared in the Clerk's Office, A Oliver and James K. Reed, the subscribing witnesses to the last will and testament of Floyd McKay late of the said County, deceased, who being duly sworn said they saw Floyd McKay sign and seal the foregoing paper as his will, and that they each subscribed the same as witnesses in the presence of each other and in the presence and at the request of said Floyd McKay. These deponents further say that they said Floyd McKay was at the time of making and executing said paper as his will, of full age to devise his property, and of sound mind and memory and not under coercion and restraint, and that he did publish and declare the same to be his will. And further saith not.
