The Last Will & Testament of James Mackay

xxxxxI, James McKay of the Parish of Beckfort and County of Shenandoah, give and bequeath to my beloved wife, Mary, that part of my plantation known whereon now I live, beginning at the lower ford and including the lower field and also the pasture adjoining along the hillside and timber for the support of same, and that part of my dwelling house called by room and also the lower ben, and likewise two heads two cows and calves two yearling heifers all which shall be of her own choosing and likewise the Darbey mare which after the decease shall fall to Susannah Coile the wife of John Coile, and also what pewter teapots or other vessels she may think necessary for her support, and also six sheep and one breeding sow and six others all of her own choosing, all the above movables to be disposed of at her death as she shall think proper, and the land to fall to my son Robert who is to find her a full supply of firewood during her life.

xxxxxItem: I give to my elder son James deceased his children that part of my plantation whereon his widow now lives, 400 acres, on the road that leads to Weaver's Mill to be equally divided among them, which land I give and bequeath unto them and their heirs and assigns forever, reserving to my daughter-in-law, wife of my son James deceased one half of the land for her support during her widowhood.

xxxxxItem: I give and bequeath to my son Robert that part of my plantation where I now live beginning at the line bequeathed to my son James his children thence down the bottom including the whole of the same, my wife's part only expected, to the lower ford together with a survey of 127 acres adjoining Thomas Buck's and Isaac Hite's lines including the same whereon he now lives, to begin at the run where my son Robert now lives to a new cross fence near the line of my son James children's land.

xxxxxItem: My further will and desire is that after my decease there should fall to my share any more land than what is here bequeathed, that the same be equally divided between my daughters Viz: Nancy, Susannah and Lidia until they shall have as much land in proportion returning what they have, as I have given my son Robert, and if any overplus, to be equally divided among my children.

xxxxxItem: My further will is that the remainder of my moveable estate be sold by my executors that is not bequeathed and used to pay my debts and for the support of the grant suit. My further will whereas I have a tract of land lying up Mathews Creek and Andrew McKay the other half, is provided be paid all expenses of land in procuring a deed in my name for the same which half of mine I desire may be sold & the Money to be put to the same use as that of my moveable estate.

xxxxxItem: I give and bequeath to my mulatto man Sam his freedom.

xxxxxItem: I give and bequeath to Sarah Harell 3 acres of land at the lower end of the lower field.

xxxxxLastly, I do appoint my son Robert and my son-in-law John Coile to be my sole Executors of this my last will and testament.
